How to Transfer a Vehicle to Heirs After the Owner Dies

Life is uncertain, and death is inevitable. When a vehicle owner passes away, questions often arise about who inherits the vehicle and how ownership can be legally transferred. To avoid future disputes, it’s important to know the proper process. Today, MotorGuide explains step by step how to transfer a vehicle to heirs after the death of the registered owner.

Step 1: Identify the Legal Heir

The first step is to determine who has the right to inherit the vehicle. This depends on the deceased owner’s marital and family status:

  • If the deceased was married: The spouse is the primary heir. However, with the spouse’s consent, ownership can be transferred to an adult child (18 years or older).
  • If both the owner and spouse have passed away: An adult child inherits the vehicle. If children are under 18, the deceased’s parents take ownership. If parents are also deceased, a brother or sister becomes the heir.
  • If the deceased was unmarried: Parents inherit the vehicle. If parents are not alive, one of the siblings can take ownership.

Step 2: Collect the Required Documents

To carry out the transfer, you must prepare the following documents:

  • Death certificate of the deceased owner
  • Original registration certificate of the vehicle
  • Valid income license at the date of death
  • Photocopies of children’s birth certificates (if applicable)
  • Photocopy of marriage certificate (if the deceased was married)
  • Forms MTA 7 and MTA 5 (issued by RMV)
  • Photocopy of National ID card or Driving License of the transferee
  • Two certified passport-size photographs of the transferee
  • Spouse’s consent letter (certified by Grama Sevaka and countersigned by Divisional Registrar)
  • If children are over 18, their written consent letter (certified and countersigned as above)
  • Final court order (only if the vehicle is part of an estate case)

Step 3: Submit Documents to the RMV

Unlike a normal vehicle transfer, a posthumous transfer requires submission at specific RMV offices:

  • RMV Head Office, Narahenpita
  • District offices with Deputy Commissioners (Gampaha, Kurunegala, Anuradhapura, Jaffna, or Hambantota)

Important: Same-day service is not available for transfers after death. It typically takes about a month to receive the revised registration certificate once the documents are accepted.

Transferring a vehicle after the owner’s death requires proper documentation and patience. By correctly identifying heirs, preparing the necessary documents, and submitting them to the right RMV office, you can complete the process without unnecessary hassle. Always keep copies of the documents for your records to avoid delays.
